Risk Warning
This is a risk warning given in accordance with the provisions of the Civil Liability Act 2002. Paddling / participating in a dragon boat is a dangerous recreational activity which involves a number of significant risks of physical harm. Dragon boating has a number of obvious risks and a number of risks which are not as obvious, but which can nevertheless give rise to a significant risk of physical harm.
When engaging in dragon boating, participants are warned of the following risks (and not limited to): death by drowning, death, permanent disability, paralysis, shoulder dislocation, rotator cuff injuries, broken limbs, blisters, back complaints (including disc prolapse), bruising, needle stick injuries, cuts, cuts from broken glass, viral and bacterial infections from water pollution, shark attack, hypothermia, dehydration, sunstroke, sun burn, skin cancer, exhaustion and lack of concentration.
A number of the risks identified above are clearly obvious and are inherent in the sport. However, a number of the above risks arise from the environment in which dragon boating is conducted (for example, where and how we load the boats, use of a slippery ramp etc). None of the risks identified above should be ignored or taken lightly by those participating in dragon boating.
Fitness to Participate
I declare that I am medically and physically fit and able to participate in dragon boating activity. I will immediately notify ‘Sandy Point Dragons’ in writing of any change to my medical condition, fitness or ability to participate in such activity. I acknowledge and accept that ‘Sandy Point Dragons’ will continue to rely upon this declaration as evidence of my fitness and ability to participate in dragon boating.
Right to use Image
I acknowledge and consent to photographs and electronic images being taken of me during my participation in dragon boating and associated activity. I understand and agree that such photographs and electronic images are owned by ‘Sandy Point Dragons’ and that they (Sandy Point Dragons) may use such media for promotional or other purposes without my further consent being necessary. Additionally, I consent to ‘Sandy Point Dragons’ using my name, image, likeness and also my performance in dragon boating and related activity, at any time, by any form of media to promote dragon boating and associated activity.
Declaration
I warrant that the information provided is true and correct. I acknowledge that this waiver declaration can not be amended. If I do amend it, my participation in dragon boating may be null and void.
Waiver Indemnity
1. Sole Risk
The participant in any and all dragon boat training sessions solely at his or her own risk with understanding of the above risks. The participant agrees that he or she will not hold ‘Sandy Point Dragons’ or any of its members, officers or agents liable for any injury, loss or damage sustained as a result of and/or in any way arising from the participating in any dragon boat training sessions.

2. Waiver of Liability
The participant agrees to indemnify ‘Sandy Point Dragons’ and its members, officers or agents against any and all claims, demands, actions, proceedings, judgments, liability, damages, costs and expenses resulting in any injury, loss or damage to any person or property howsoever caused and arising as a result from participating in any dragon boat training sessions.
